Mr. Faecher has significant experience assisting clients in their acquisition and development of environmentally impaired properties using TRC’s Exit Strategy program. He routinely works with corporations and developers in structuring programs designed to manage the cleanup liability and risk associated with the redevelopment of Brownfield sites. Mr. Faecher has also structured Exit Strategy transactions to resolve complex multi-party cost recovery litigation and to manage the environmental liability associated with the sale of business assets and capital re-financing transactions. Mr. Faecher is the national lead for TRC’s Exit Strategy Small Affordable Risk Transfer (SMART™) program which enables TRC to deliver Exit Strategy solutions to projects having expected remediation value less than $5 million.
Prior to joining TRC, Mr. Faecher was a partner in a major New Jersey law firm where he regularly represented clients before the New Jersey Department of Environmental Protection and the U.S. Environmental Protection Agency in environmental cleanup, permitting and enforcement actions. Mr. Faecher handled numerous multi-million dollar pollution remediation and transactional due diligence matters involving both single assets and portfolios of real estate. He also represented clients compelled to remediate sites under New Jersey’s Industrial Site Recovery Act (ISRA) statute, and handled the recovery of cleanup costs under various State and Federal Brownfield and Innocent Purchaser Grant programs, and via cost recovery and insurance coverage litigation.
Mr. Faecher received his J.D. Degree from the American University, Washington College of Law and a Bachelor of Arts Degree from Muhlenberg College. He is admitted to practice before the New Jersey State and U.S. District Courts, U.S. Court of Appeals for the Third Circuit and in the District of Columbia. Mr. Faecher is a member of the environmental sections of the New Jersey and American Bar Associations. |
